Comment period completed on FBO fuel-spill proposal

Last month saw the deadline on the second of two notices of proposed rulemaking to ease fuel-spill prevention, control and containment (SPCC) rules for fuel trucks and fuel farms. Under the proposal, fuel suppliers would no longer be required to have “sized secondary containment,” removing the mandate that fuel trucks must be parked in special containment or “bermed” areas when not in service.

This proposal would also allow facilities that store fewer than 10,000 gallons of fuel/ oil to “self certify” their SPCC implementation plans, rather than use the services of professional engineers. An earlier proposal (comments were accepted through January 11) would extend the compliance date from August 18 this year to October 31 next year for FBOs and other fueling providers to implement SPCC plans.
