The FAA has granted dozens of Part 135 (and a few Part 121) petitioners permission to operate without being equipped with required mode-S transponders. The agency has been flooded with petitions for exemption since the requirement–FAR 135.142(c)– was put into effect in January. Cost and justification are the common thread cited by most petitioners. The FAA declined to comment.
