Next step for the pilots is their testimony in the case, scheduled to take place in Brazil on August 27. But while the judge has scheduled the pilots to testify at this time, the question remains whether they’ll be required to return to Brazil to do so. According to Joel Weiss, the attorney for the pilots, the issue comes down to an extradition treaty between the U.S. and Brazil. Weiss told AIN that while the two countries have an extradition treaty, it does not include a provision for this particular charge, suggesting that extradition remains unlikely at this time. The International Federation of Air Line Pilots Associations quickly responded to the indictment, saying, “Allowing a police investigation to pre-empt the findings of the independent technically competent investigation will not help to establish the sequence of events that led to the tragic midair collision and, as a result, an opportunity to improve the safety of the air transport system will be lost.”
