Effective April 4, 2016, the DOT has extended the smoking ban for Part 135 unscheduled charters requiring a flight attendant (i.e. aircraft with 19 or more passenger seats) to explicitly include banning electronic cigarettes (“e-cigarettes”) on all flights. The Department has always interpreted the existing smoking ban to prohibit e-cigarettes, but it is codifying this interpretation in the FARs.
